This Goddard Education Foundation (GEF) Scholarship Raffle (“Raffle”) is sponsored by Credit Union of America, First National Bank of Hutchinson, and Tanganyika Wildlife Park.

 

1. Eligibility: To purchase a ticket (“Ticket”) to enter the Raffle, you must be a legal resident of the 50 United States or District of Columbia and be 18 years or older at the time of purchase of the Ticket. GEF’s employees, officers, trustees and their immediate families are ineligible from claiming a prize. Employees, officers, and directors of Credit Union of America, First National Bank of Hutchinson, Tanganyika Wildlife Park, and their immediate families are ineligible from claiming a prize. Employees, officers, and directors of BFR CPA LLC, and their immediate families are ineligible from claiming a prize. Board of Education Members of the Sedgwick County, Kansas, Goddard Public Schools, Unified School District Number 265, and their immediate families are ineligible from claiming a prize. Officers and directors from corporate partners of the Goddard Education Foundation supporting the Scholarship Raffle, including, but not limited to, Credit Union of America, First National Bank of Hutchinson, K12itc, and their immediate families, are ineligible from claiming a prize. “Immediate Family” consists of parents, siblings, and/or children. Also, “Immediate Family” includes any person, whether related or not, residing in the same household with those named above as ineligible to participate or claim a prize.

 

2. How to Enter: A maximum of 6,000 Tickets will be sold at $25.00 for individual Tickets, or $100.00 for five Tickets. The IRS has taken the position
that amounts paid for chances in raffles, lotteries, or similar drawings are not gifts and consequently do not qualify as tax-deductible contributions. Any one individual can purchase a Ticket, or any number of individuals can join in the purchase of a Ticket. Participants in a group entry must identify a single person as the individual to whom a prize will be awarded by the GEF. That name only must be listed as the entrant on the front of the Ticket and will be deemed the holder of the Ticket (the “Ticket Holder”). If the name of more than one (1) person is provided on a Ticket purchase form, then the person whose name is listed first on the 2022 Ticket purchase form will be deemed the Ticket Holder. The division of any prize among two or more persons jointly purchasing a Ticket shall be the sole responsibility of such persons. GEF is not responsible for resolving any claims or disputes that may arise from or among the different individuals jointly purchasing a Ticket. A maximum of 6,000 Tickets, numbered 1 through 6,000, will be sold. Ticket sales will begin at 10:00 a.m. Central Time, Tuesday, April 4th, 2022. Tickets sales will conclude at 11:59:59 p.m. Central Time, Monday, May 16, 2022. Tickets may sell out before that time. An individual may purchase as many tickets as he or she may wish, subject to availability. Tickets cannot be bought in the name of businesses, trusts, corporations, or other entities. Tickets are available online at www.goddardef.org distributed from time to time in local media, events, or may be requested by writing or in person at Goddard Education Foundation of Goddard Public Schools at 201 S. Main, Goddard, KS 67052 or by phone at (316) 794-4000. Ticket purchases can be made with valid credit card or debit card (Visa, MasterCard, Discover) numbers, security code, and expiration dates (subject to any applicable legal or card issuer restrictions), or by check or money order payable to “Goddard Education Foundation,” or in cash in person at 201 S. Main St., Goddard, KS. Tickets cannot be bought by e-mail, voicemail, or any other credit card, debit card, check card, “PayPal,” or similar method. GEF reserves the right to reject any purchase form submitted without proper payment or payment that does not constitute “good funds,” as determined in GEF’s sole discretion. All numbered Tickets will be emailed and will serve as the receipt of purchase. All sales are final. No refunds will be made except under the following circumstances: any Ticket purchase form received after 6,000 Tickets have been sold or received after 11:59:59 p.m. Central Time on May 16th, 2022. No other refunds are available except at the sole discretion of GEF. In the event the buyer does not want to participate in the Raffle and instead wishes to claim a tax-deductible donation, written notice of said intent not to participate in the Raffle must be received by GEF no later than 11:59:59 p.m. Central Time on Tuesday, May 17th, 2022. 3. Prize Drawings. Prize drawings will be conducted under the supervision of a certified public accountant or other independent judging organization. All drawings are open to the public. Ticket holders need not be present to win. Winners will be selected at random. In the event that the payment received does not constitute “good funds” as determined by GEF, the winner automatically forfeits their right to claim a prize and a new Ticket will be selected under the supervision of a certified public accountant or other independent judging organization.

First Early Bird Drawing: A first Early Bird Drawing for the “Ultimate Wind Surge Experience” will be held at 5:00 p.m. on Wednesday, April 20, 2022, at 201 S. Main St., Goddard KS, from among all Tickets sold on or before 11:59:59 p.m. Central Time on Friday, April 15, 2022. The first Early Bird drawing winner will still be entered for the Scholarship (First Prize). The Ultimate Wind Surge Experience Package winner will receive an autographed baseball bat, autographed baseball, four tickets to attend the Wichita Wind Surge Baseball Game on Saturday, May 21, 2022. During the attendance of this game, the winner will get to take a picture with Windy, the Wichita Wind Surge Mascot; the opportunity to throw the 'First Pitch' before the start of a Wichita Wind Surge Game; $100.00 Store Voucher (not redeemable for cash) at the Wichita Team Store; and, on a different date, separate and apart from the game day, as agreed upon by the Wichita Wind Surge management team, receive a behind-the-scenes tour of the Wichita Riverfront Stadium for the winner and up to three additional guests. The winner and guests must follow all current MLB + Covid-19 Protocols during their visit(s). Total Prize value is $1,400.00. To successfully redeem the First Early Bird Prize, the winner must complete IRS Form 5754 at the time of redemption.

Second Early Bird Drawing: A second Early Bird Drawing for the “Overnight Safari Experience at Tanganyika Wildlife Park” will be held at 5:00 p.m. on Wednesday, May 4, 2022, at 201 S. Main St., Goddard, KS, from among all Tickets sold on or before 11:59:59 p.m. Central Time on Friday, April 29, 2022. The second Early Bird drawing winner will still be entered for the Scholarship (First Prize). The “Overnight Safari Experience at Tanganyika Wildlife Park” winner will receive a Single Day Admission + Unlimited Feedings + 2 experiences for one family (up to 6 people). The Winner and immediate family (up to 6 people) will have the opportunity to stay in the Hawkins Estate for one night. The winner’s contact information will be given to the Tanganyika concierge, who will reach out to the winner to schedule all the experiences and the stay. Restrictions for the prize include: All participants in the experiences must be at least three years old; At least one adult must be present with children under 16 at all times at the Hawkins Estate or in the Park; Limited to immediate family members; must be used during the 2022 season. The total prize value is $3200.00. To successfully redeem the Second Early Bird Prize, the winner must complete IRS Form 5754 at the time of redemption.

 

Third Early Bird Drawing: A third Early Bird Drawing for the “Semester Scholarship” will be held at 5:00 p.m. on Wednesday, May 18th, 2022, at 201 S. Main St., Goddard KS, from among all Tickets sold on or before 11:59:59 p.m. Central Time on Friday, May 13, 2022. The third Early Bird drawing winner will still be entered for the Scholarship (First Prize). The Third Early Bird winner must provide GEF with written notice of his/her selection of the ‘Semester Scholarship’ (Maximum of $12,000 Scholarship) or the alternate $4,000 cash prize on or before noon Central Time on June 3, 2022. If GEF receives no notice by such date and time, then the Third Early Bird Prize winner will be automatically deemed to have elected not to accept the Scholarship and elected to receive the alternate $4,000 cash prize as complete satisfaction of the First Prize. In the event the alternate $4,000 cash prize is selected, the winner must successfully complete IRS Form 5754 to redeem. In the event the Scholarship is selected, the Goddard Education Foundation will contribute no more than $12,000 directly to the college(s) or university(es) of choice on behalf of the student(s) for qualified educational expenses. If the scholarship is selected, the winner must be attending a college or university the Fall semester of 2022. The college(s) or university(ies) must be selected and the winner must complete the required documents as determined in the sole discretion of the GEF, by 11:59 p.m. on September 1, 2022. If GEF receives no notice or required documentation by such date and time, then the First Prize scholarship will expire, the winner will be automatically deemed to have elected not to accept the Semester Scholarship, will forfeit the right to claim the third early bird prize, and the funds will be transferred to the Goddard Education Foundation general funds.

 

First Prize (GRAND PRIZE) Drawing: The Drawing for the $25,000 Scholarship (First Prize) will be held at 5:00 p.m. on May 20, 2022, from among all Tickets sold on or before 11:59:59 p.m. Central Time on Monday, May 16, 2022. At the option of GEF, the drawings for the First and remaining prizes may take place earlier if all 6,000 Tickets have been sold.

First Prize (1): The First Prize winner will be awarded a choice of (i) a $25,000 scholarship to pay towards the college or university of choice (ii) or a $25,000 cash prize.

The First Prize winner must provide GEF with written notice of his/her selection of the $25,000 Scholarship or the alternate $25,000 cash prize on or before noon Central Time on June 3, 2022. If GEF receives no notice by such date and time, then the First Prize winner will be automatically deemed to have elected not to accept the Scholarship and elected to receive the alternate $25,000 cash prize as complete satisfaction of the First Prize.

In the event the Scholarship is selected, the Goddard Education Foundation will contribute no more than $25,000 to the college(s) or university(es) of choice on behalf of the student(s) for qualified educational expenses. If the scholarship is selected, the winner must be attending a college or university in the Fall semester of 2022. If the scholarship is selected, the college(s) or university(ies) must be selected, and the winner must complete the required documents as determined in the sole discretion of the GEF, by 11:59 p.m. on September 1, 2022. If GEF receives no notice or the required documents by such date and time, then the First Prize scholarship will expire, and the winner will be automatically deemed to have elected not to accept the Scholarship, will forfeit the right to claim the First Prize and the funds will be transferred to the Goddard Education Foundation general funds.

The odds of winning a prize depend on the number of Tickets sold. If all 6,000 Tickets are sold, the odds of winning the First prize are 1 in 6,000. If fewer Tickets are sold, the odds of winning the First Prize and Early Bird Prize improve.

No substitute for prizes as listed. Prizes are non-assignable and non-transferable.

If the Scholarship or Cash Prize is chosen and awarded as the prize, then the First Prize winner assumes all local, state, and federal taxes (including, but not limited to, income taxes and any other federal, state, and local taxes), which must be paid or withheld at the time the First Prize Winner claims their prize. The GEF makes no guarantee that the Internal Revenue Service (IRS) will accept the $25,000 scholarship will be utilized for qualified educational expenses for determining any income tax that may be due from the First Prize winner.

Prize winners are solely responsible for all local, state, and federal taxes resulting from the income attributable to the receipt of any prizes. First prize winners understand and agree that the prize winner must pay at the time of receipt of the award, by means of cash payment or withholding from cash prizes, estimated federal and state income tax on all prizes having a value in excess of $5,000. For any prizes valued at $5,000 or more, the prize is subject to applicable federal and state withholding. For any prizes valued at $600 or more, the GEF will file IRS Form W-2G with the Internal Revenue Service reporting the value of the prize as income to the winner. Prize winners should consult their professional legal and accounting advisors regarding the tax effects of their respective choices.

GEF will make reasonable efforts to contact the person named on a winning Ticket, using only the information on the winning Ticket purchase form. If, despite those efforts, the person named on a winning Ticket cannot be located within 30 calendar days after the drawing, or if any such person is ineligible under these Rules or applicable law, then that person will not be awarded the prize. Up to three alternate ticket numbers will be drawn at each respective drawing date and time for the early birds and first prize drawings. In the order drawn, the alternate ticket number(s) will be contacted to claim said prize. Any prize that is not claimed within 90 calendar days after the drawing for that prize will not be awarded and retained by the GEF.

In order to collect his or her prize, a winner may be required to sign and deliver to GEF: (a) a sworn affidavit of eligibility and publicity/liability release in accordance with these Rules and applicable law, including without limitation that he or she is a U.S. resident and at least 18 years old at the time of purchase of a Ticket; (b) such written information as is required by any applicable tax and/or real estate laws, including without limitation his or her Social Security Number; and (c) a U.S. driver's license or other government-issued proof of identity in form(s) satisfactory to GEF showing that the person claiming the prize is the same person who is named on the winning Ticket.


5. General Terms and Conditions: a. The Raffle is subject to these Official Rules. These Official Rules cannot be changed by any oral statement made by any employee, consultant, or agent acting on behalf of GEF. To the extent information contained in these Official Rules, on the Ticket purchase form, on the www.goddardef.org website, or in any other media conflict, the terms and conditions of these Official Rules shall govern and prevail.

b. By entering the Raffle, entrants accept and agree: (1) to be bound by these Official Rules and the decisions of GEF, which shall be final and binding in all matters related to the Raffle; (2) to waive any right to claim ambiguity in the Raffle or these Official Rules; and (3) that GEF may use the entrant’s name, photograph, likeness, statements, biographical information, voice and city and state address for promotional or advertising purposes in connection with the Raffle and GEF, and in all forms of media, now or hereafter known, in perpetuity, without review, permission or further compensation, on a worldwide basis, except where prohibited by law.

c. BY ENTERING THE RAFFLE EACH ENTRANT RELEASES GEF AND CREDIT UNION OF AMERICA, FIRST NATIONAL BANK, WICHITA WIND SURGE, TANGANYIKA WILDLIFE PARK, THEIR DIRECTORS, OFFICERS, EMPLOYEES AND AGENTS FROM ANY AND ALL LIABILITY FOR INJURIES, LOSSES OR DAMAGES OF ANY KIND (INCLUDING, WITHOUT LIMITATION, ATTORNEY’S FEES) CAUSED BY PARTICIPATING IN THE RAFFLE OR WINNING ANY PRIZE OR RESULTING FROM ACCEPTANCE, POSSESSION, USE OR MISUSE OF ANY PRIZE, AND EACH WINNER AGREES TO INDEMNIFY AND HOLD GEF AND CREDIT UNION OF AMERICA, FIRST NATIONAL BANK, WICHITA WIND SURGE, TANGANYIKA WILDLIFE PARK HARMLESS FROM ANY AND ALL LOSSES, DAMAGES, RIGHTS, CLAIMS, AND ACTIONS OF ANY KIND ARISING FROM, IN CONNECTION WITH, OR AS A RESULT OF PARTICIPATING IN THE RAFFLE OR THE WINNER’S ACCEPTANCE OR USE OF ANY PRIZE.

d. GEF is not responsible for incomplete, illegible, misdirected, misprinted, non-delivered, late, lost, damaged, stolen, or postage-due submissions or prize notifications; for lost, interrupted, inaccessible, malfunctioning, or unavailable networks, servers, satellites, Internet Service Providers, websites, or other connections; for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; for any damage to an entrant's computer system which is occasioned by accessing the GEF website; or for the incorrect or inaccurate capture of information or the failure to capture any information; or other errors of any kind, whether human or technical in nature. GEF reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Raffle, to be acting in violation of these Official Rules, or to be acting in a disruptive manner, or with the intent to disrupt or undermine the fair operation of the Raffle, or to annoy, abuse, threaten or harass any other person, and GEF reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law.

e. In the event GEF is prevented from awarding prizes or continuing with the Raffle as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man-made epidemic of health, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), any federal, state or local government law, order, or regulation, public health crisis, order of any court or jurisdiction, or other cause not reasonably within GEF’ control (each a “Force Majeure” event or occurrence), then subject to any governmental approval which may be required, GEF shall have the right to modify, suspend, extend or terminate the Raffle. If the Raffle is terminated for Force Majeure before the designated end date, a Ticket Holder’s/participant’s sole and exclusive remedy shall be to receive a refund of the full purchase price, without interest, paid by such holder/participant for each Certificate.

f. This Raffle is subject to all U.S. federal, state and local laws and regulations and is void outside the United States and where prohibited. By participating in this Raffle, each participant agrees that any and all issues, disputes, claims, and causes of action arising out of or connected with the Raffle or any prize awarded shall be governed and construed in accordance with the laws of the State of Kansas, without regard to choice of law or conflict of law principles, and resolved individually, without resort to any form of class action, exclusively by an appropriate court located in Wichita, KS.

 

6. Winners’ List. A list of winners will be posted publicly to include, but not limited to, the GEF websitewww.goddardef.org within 30 days of verification of all winners. A copy of the winners’ list may be obtained by sending a self-addressed, stamped envelope to Goddard Education Foundation, 201 S. Main St., Goddard, KS 67052. Requests must be received by June 30, 2022.

 

7. Raffle License. The GEF has a Raffle License RAF000160 on file with the Kansas Department of Revenue, Charitable Gaming.
